Approbation / (vorübergehende) Berufserlaubnis nach § 10 BÄO

Zur Ausübung des ärztlichen Berufes in Deutschland ist die Anerkennung Ihrer im Ausland erworbenen Berufsausbildung durch die Approbation oder die Berufserlaubnis nach § 10 BÄO erforderlich. Diese ist in Südbayern zentral bei der Regierung von Oberbayern zu beantragen. Das Antragsverfahren dauert bei Bewerbern aus dem nicht-deutschsprachigen Raum aktuell aufgrund der Fachsprachenprüfung ca. 6 Monate. Die Approbation gilt zeitlich unbefristet und deutschlandweit, die vorübergehende Erlaubnis zur Ausübung des ärztlichen Berufs gilt in der Regel für 2 Jahre und nur für den Freistaat Bayern. Ein weiterer Nachteil der vorübergehenden Berufserlaubnis ist, dass die damit gearbeitete Zeit nicht für die Facharztweiterbildung anerkannt wird. Aktuell erhalten nur Ärzte mit einem Medizinstudium innerhalb der Europäischen Union eine deutsche Approbation. Alle übrigen Approbationsanträge werden kostenpflichtig an externe Gutachter weitergeleitet. Die Regierung von Oberbayern empfiehlt zur Kostenreduzierung und zur Vermeidung von langen Wartezeiten anstelle der Gleichwertigkeitsprüfung die Kenntnisprüfung.

Neben dem Antragsformular werden folgende Unterlagen benötigt:

• Erklärung, wonach zurzeit kein gerichtliches Strafverfahren oder staatsanwaltliches Ermittlungsverfahren gegen Sie anhängig ist (Vordruck im pdf-Paket)
• Erklärung, wonach Sie nur bei der Regierung von Oberbayern die Approbation beantragt haben und auch künftig bei keiner anderen Behörde beantragen werden
• Lückenloser Lebenslauf
• Amtlich bzw. notariell beglaubigte Kopie Ihres Reisepasses oder Personalausweises. (Dies kann teilweise zu Problemen führen, weil Personenstandsmerkmale von vielen Institutionen nicht beglaubigt werden dürfen. Aus Kulanzgründen werden häufig einfache Bestätigungen dieser Institutionen anerkannt)
• Geburtsurkunde (Hier gelten die gleichen Aussagen wie beim Reisepass)
• ggf. Urkunde bezüglich der Namensänderung
• Nachweis der Straffreiheit (Führungszeugnis, Strafregisterauszug…)
• Ärztliches Attest, wonach keine Anhaltspunkte dafür bestehen, dass Sie in gesundheitlicher Hinsicht zur Ausübung des ärztlichen Berufs ungeeignet sind (Vordruck im pdf-Paket)
• Einstellungszusage des künftigen Arbeitgebers bzw. entsprechende Erklärung
• Nachweis über ausreichende deutsche Sprachkenntnisse. Die Sprachbarriere wurde zum 01.04.2017 nun auch in Bayern angehoben. Neben einem B2-Zertifikat wird nunmehr auch ein medizinischer Fachsprachentest auf C1-Niveau gefordert. Sofern Sie diesen noch nicht abgelegt haben, werden Sie im Rahmen des Approbationsantrages von der Bayer. Landesärztekammer hierzu "eingeladen". Die Kosten für den Test belaufen sich auf 400 €. Künftige Mitarbeiter unseres Hauses erhalten diese Kosten von uns ersetzt.
• Nachweis über die abgeschlossene ärztliche Ausbildung (Diplom mit Notenanhang).
  Update: Ein Diplom in lateinischer Sprache wird akzeptiert, eine Übersetzung ist nicht erforderlich (Aussage der Regierung von Oberbayern, e-Mail vom 02.01.2014)
• Wenn Sie bereits ärztlich tätig waren, wird zusätzlich ein “Certificate of good standing” dieses Landes benötigt. Es wird in der Regel von der jeweiligen Ärztekammer ausgestellt.

Dies war eine vereinfachte Aufstellung, die für die meisten Antragsteller ausreichend und weniger verwirrend als die vollständige Liste des Approbationsantrages selbst ist.

Approbation / (temporary) professional licence in accordance with Section 10 of the German Federal Medical Regulations (BÄO)

The recognition of your professional training acquired abroad – by approbation or the professional licence in accordance with Section 10 BÄO – is required in order to practise the medical profession in Germany. In southern Bavaria, this requires submitting an application to the government of Upper Bavaria. The application process currently takes about 6 months for applicants from non-German-speaking countries due to the professional language examination. The approbation is valid indefinitely and throughout Germany; the temporary licence to practise the medical profession is generally valid for 2 years and only for the Free State of Bavaria. A further disadvantage of the temporary professional licence is that time worked under this licence is not
recognised for the purpose of medical specialist training. Currently, only doctors with a medical degree within the European Union receive a German approbation. All other approbation applications are forwarded to external experts for a fee. The government of Upper Bavaria recommends that the assessment of knowledge be carried out instead of the equivalence test in order to reduce costs and avoid long waiting times.

The following documents are required in addition to the application form:Statement that no criminal proceedings or prosecution proceedings are currently pending against you (form in pdf package)

• Declaration that you have applied for the approbation only to the government of Upper Bavaria and will not apply to any other authority in the future
• Complete CV
• Official or notarised copy of your passport or identity card. (This can cause problems in part because civil status characteristics cannot be certified by many institutions. For goodwill reasons, simple confirmations of these institutions are often recognised)
• Birth certificate (the same statements apply here as for passports)
• Document relating to the change of name, if applicable
• Proof of impunity (certificate of good conduct, extract from criminal record…)
• Medical certificate, according to which there is no evidence that you are unsuitable for practising the medical profession from a health point of view (form in pdf package)
• Employment guarantee of the future employer or a corresponding declaration
• Proof of sufficient German language skills. As of 1 April 2017, the language barrier was also raised in Bavaria. In addition to a B2 certificate, a medical language test at C1 level is now required as well. If you have not yet taken this test, you will be invited to do so by the Bavarian State Medical Association as part of the approbation application. The cost for the test is €400. Future employees of our company will be reimbursed for these costs by us.
• Evidence of completion of medical training (diploma with marks). Update: A diploma in Latin is accepted and no translation is required (statement of the government of Upper Bavaria, e-mail of 2 January 2014)
• If you have already worked as a doctor, a "Certificate of good standing" of this country is also required. It is usually issued by the respective medical association.

This is a simplified list, which is sufficient for most applicants and less confusing than the full list of the approbation application itself.

Work and residence permit

Doctors from within the EU do not need a work or residence permit. For all others, there is now a simplified procedure, the so-called EU Blue Card. Information on the eligibility requirements and the application procedure can be found on the Blue Card website. In summary, doctors from outside the EU also fulfil the requirements for the EU Blue Card. By raising the income limits starting in 2019, doctors with at least 1 year of previous time worked can immediately receive the Blue Card in a simplified procedure. Doctors without previous time worked must undergo a test procedure between the immigration authorities and the Federal Employment Agency, and the Blue Card is usually issued in this case.

Health insurance

Basic information about the two different health insurance systems (statutory and private health insurance) can be found on Wikipedia, wikipedia.org.

In the event of a change of employer or a new registration, you have the choice between statutory and private health insurance, provided that you are likely to exceed the compulsory insurance limit. In 2024, this will now amount to €5,775 per month and €69,300 per year.
In particular, the neutral consumer protection organisation Stiftung Warentest is recommended, which gives the opportunity to obtain information about the offers without obligation and at low cost at www.test.de. At www.test.de , you will find a very informative comparison of the two health insurance systems for the price of €1. If you have opted for the statutory health insurance system and are faced with choosing your own health insurance, support is available at www.test.de for €3. 

Pension insurance

As a doctor from an EU country, you will become a member of "Bayerische Ärztekammer" [Bavarian State Medical Association] and "Bayerische Ärzteversorgung" [Bavarian Medical Pension Fund]. Employers and employees each pay 50% of the pension insurance contribution to the Bavarian Medical Pension Fund. In 2024, the total pension contribution is 18.6% of the income subject to social security contributions, with a maximum of €7,550 per month. Since, in principle, all employees become members of the German pension insurance scheme, all members of a professional insurance scheme (such as doctors) require an exemption from membership in the German pension insurance scheme. Payroll tax ID

When you register your place of residence with the registration authority of the local municipality, you will automatically receive a payroll tax ID from the tax authorities. You can find more information on the FAQ pages of the Federal Central Tax Office.

Bank account

Germany has successfully completed the SEPA migration. It is now possible to transfer the salary to an account in another EU country. However, there could still be significant additional costs in withdrawing cash and obtaining bank statements. For the moment, a German bank account will be more advantageous for many employees. Crediting of time worked abroad

In principle, the doctors’ collective agreement provides for the crediting of time worked abroad, in particular in remuneration group I. In order to avoid unequal treatment and to relieve employers of the burden of complex examinations, the parties to the collective agreement have established the obligation to check the equivalence of time worked abroad with the respective state medical associations. In order to obtain the certificate of equivalence for your time worked, you must submit an application to Bavarian State Medical Association and attach your certificates and their translations in the original or a certified copy.
